Roster Reunion ("Roster Reunion", “Rosterreunion.com”, "us", "we", and "our") is a social networking website that allows members to create unique personal profiles online in order to find and communicate with old and new teammates. By using or accessing the Roster Reunion website (the “Website”) you agree to be bound by these Terms of Use (the "Terms"), whether or not you sign up as a member ("Member"). The Website and related services (the “Services”) are hosted in the United States.

Please review our Privacy Policy, which is incorporated herein by reference, for information about what information we collect and how it is used.

The Terms may be modified from time to time and such modification shall be effective upon posting by Roster Reunion on the Website. You agree to be bound to any changes to these Terms when you use the Website and/or the Services after any such modification is posted. If you do not agree to these Terms, you must discontinue use of the Website and/or the Services immediately. We suggest that you print out a copy of these Terms for your reference.

Terms of Use

1) Eligibility.

1. Use of the Website, the Services and membership is void where prohibited. By using the Website and/or the Services, you represent and warrant that all the information that you submitted when you signed up is truthful and accurate; that you agree to maintain the accuracy of such information; you are 13 years of age or older; and your use of the Website and/or the Services do not violate any applicable laws, rules and regulations.
    
2. Roster Reunion does not knowingly collect or solicit personal information from anyone under 13 years of age or knowingly allow such persons to sign up. If you are under 13 years of age, please do not attempt to become a Member or send any information about yourself to us, including your name, address, telephone number, or email address. If you believe that we might have any information from or about a person under 13 years of age, please contact us at info@rosterreunion.com.

2) Term.

These Terms, and any posted modification to these Terms, shall remain in full force while you use the Website, the Services or are a Member. You may terminate your membership at any time, for any reason, by following the instructions indicated in the Frequently Asked Questions posted at http://www.rosterreunion.com/faq.php. Roster Reunion expressly reserves the right to remove your profile and/or suspend, restrict, or terminate your access to the Website or the Services or your membership if Roster Reunion determines, in its sole discretion, that you have violated these Terms or the spirit of these Terms or pose a threat to Roster Reunion, its employees, business partners, Members and/or the public. Even after your membership is terminated, these Terms will remain in effect, including, without limitation, Sections 1(a),2,3,5,7,8,9,10,11,12,13 and 14.

3) Fees.

You acknowledge that Roster Reunion reserves the right to charge a fee for any portion of the Website and/or the Services and has the right to change its fees from time to time in its sole discretion. Roster Reunion reserves the right to terminate a Member's membership if such Member should fail to pay for use of the Website and/or the Services, as required by these Terms.

4) Password.

When you sign up to become a Member, you will be asked to choose a password and you are responsible for maintaining the confidentiality of your password. You agree not to use the account, the Nickname (username), email address or password of another Member at anytime or to disclose your password to any third party. You agree to notify Roster Reunion immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for the use of your account.

5) Your Interactions with other Members.

You are solely responsible for your interactions and communications with other Members and any consequences thereof while using the Website and/or the Services. You understand that Roster Reunion does not in any way screen its Members, nor does Roster Reunion inquire into the backgrounds of its Members or attempt to verify the statements of its Members. Roster Reunion makes no representations or warranties as to the conduct of Members or their compatibility with any current or future Members. By participating in any offline Roster Reunion event or any Member posted/created event, you agree to release and hold Roster Reunion harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, either directly or indirectly related to or arising from your participation in any such offline event.

6) Non Commercial Use by Members.

The Website and the Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved in writing by Roster Reunion. Illegal and/or unauthorized use of the Website and/or the Services, including, without limitation, the collection of usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website are prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of membership privileges.

7) Proprietary Rights.

1. Roster Reunion does not claim any ownership rights in the Content that you post, transmit, submit, display or publish (collectively referred to herein as, “Posting” or “Post”) on the Website or through or in connection with the Services. After Posting your Content on the Website or through or in connection with the Services, you continue to retain any such rights that you may have in such Content, subject to the license herein. By Posting your Content on the Website or through or in connection with the Services, you hereby grant to Roster Reunion a fully-paid, perpetual, irrevocable, worldwide, royalty-free, sublicensable, and non-exclusive, license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute such Content on the Website and/or the Services. This license is for the sole purpose of enabling Roster Reunion to promote the Website and/or the Services and may be revoked for certain services. After you remove your Content from the Website or the Services, the license will terminate.
    
2. You represent and warrant that you own the Content posted by you on the Website or through or in connection with the Services, or otherwise have the right to grant the license set forth in these Terms, and the Posting of any Content on the Website or through or in connection with the Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any other person or entity. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of the use of any Content on the Website through or in connection with the Services.
    
3. The Website and the Services contain Roster Reunion Content that is protected by copyright, trademark and other applicable laws, and we own and retain all rights in the Roster Reunion Content. Roster Reunion grants you a limited license to access and make personal use of the Website and/or the Services and not to download (other than page caching) or modify it, or any portion of it, except with the express written consent of Roster Reunion. This license does not include any resale or commercial use of the Website and/or the Services. This Website or any portion of the Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Roster Reunion. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Roster Reunion without the express written consent of Roster Reunion. You may not use any meta tags or any other “hidden text” utilizing Roster Reunion’s name or trademarks without the express written consent of Roster Reunion. Any unauthorized use terminates the permission or license granted by Roster Reunion.

8) Content.

1. Please choose carefully the information you Post on the Website or via the Services and that you provide to other Members. Information provided by other Members (for instance, in their profile) may contain inaccurate, inappropriate or offensive material, products or services and Roster Reunion assumes no responsibility nor liability for the Posting by Members of inaccurate, inappropriate or offensive material, products or services. If you become aware of misuse of the Website or the Services by any person, please contact us at info@rosterreunion.com.
    
2. Roster Reunion reserves the right to reject, refuse to Post or delete any Content, including, without limitation, data, text files, images, sounds, information, photos, emails, messages, videos, music, blogs, forums, posts (collectively the “Content”, and as used throughout these Terms) that in its sole discretion breaches these Terms or the spirit of these Terms, or is not up to our quality standards.
    
3. You agree that you are solely responsible (and that Roster Reunion has no responsibility to you or to any third party) for the Content that you Post on the Website or via the Services or any material or information that you transmit to other Members.
    
4. The following Content is prohibited on the Website. Roster Reunion reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending Content from the Website and/or Services and terminating the membership of such violators.
   
   Prohibited Content includes, without limitation, Content that:
   
   i. is offensive, threatening, hateful or promotes racism, bigotry or physical harm of any kind against any group, individual or animal;
   ii. contains nudity, violence, or offensive subject matter or contains a link to an adult website;
   iii. harasses, bullies or intimidates another person;
   iv. exploits people in a violent or sexual manner;
   v. provides any user identification or sensitive financial information, including telephone numbers, street addresses, last names, URLs or email addresses;
   vi. promotes or constitutes false or misleading information or conduct that is defamatory or libelous;
   vii. promotes or constitutes an illegal or unauthorized copy of another person’s copyrighted work, such as pirated software or music or links to them, or providing information to circumvent manufacture-installed copy protect devices;
   viii. involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, “spimming” or "spamming";
   ix. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
   x. furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone's privacy, promoting physical harm or injury against any group or individual, or providing or creating computer viruses;
   xi. solicits passwords, log in information or personal identifying information for commercial or unlawful purposes from other persons or from anyone under thirteen (13) years of age;
   xii. promotes, engages or otherwise makes available any unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, disruptive commercial messages, false or misleading information or any other form of solicitation;
   xiii. involves commercial activities and/or sales without our prior written consent, such as contests or sweepstakes, barter or advertising;
   xiv. transmits any viruses, worms, defects, Trojan horses, malicious code or any other items of destructive nature; or is unlawful.
    
5. You may not cover or obscure the banner advertisements on your personal profile page, or any Roster Reunion page via HTML/CSS or any other means
    
6. Any automated use of the system, such as using scripts to add friends, is prohibited.
    
7. You may not attempt to impersonate another user or person who is not a Member or an employee of Roster Reunion.
    
8. You may not conduct or be a party to any activity that interferes with, disrupts, disables or creates an undue burden on the Website and/or the Services or the networks or services connected to the Website and/or the Services.

9) Copyright Policy.

1. a. You may not Post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Roster Reunion reserves the right to terminate membership privileges of any Member who repeatedly infringes copyright upon prompt notification to Roster Reunion by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Website or the Services in a way that constitutes copyright infringement, a notification of a claim can be made to;

2. Many images on the Website are readily available in various places on the Internet and are believed to be in public domain, and such images are believed to be posted according to the U.S. Copyright Fair Use Act (title 17, U.S. Code).

10) Disclaimers.

1. Roster Reunion is not responsible for any incorrect or inaccurate content posted on the Website, through or in connection with the Services, whether caused by users of the Website, Members or by any of the equipment or programming associated with or utilized in the Services. Roster Reunion is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Services. Roster Reunion assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication. Roster Reunion is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including any injury or damage to users and/or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the Website and/or in connection with the Services. ROSTER REUNION IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES DESCRIBED ABOVE AND YOU AGREE RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU MAY WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

By providing links to other sites, Roster Reunion does not guarantee, approve or endorse the information or products available at these sites, nor does a link indicate any association with or endorsement by the linked site to Roster Reunion. Roster Reunion does not operate or control and has no responsibility for the information, products and/or services found on any external sites. Nor do such links represent or endorse the accuracy or reliability of any information, products and/or services provided on or through any external sites, including, without limitation, warranties of any kind, either express or implied, warranties of title or non-infringement or implied warranties or merchantability or fitness for a particular product. Visitors to and Members of Roster Reunion assume complete responsibility and risk in their use of any external sites. ROSTER REUNION MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE AND/OR THE SERVICES IS AT YOUR SOLE RISK. WE DO NOT WARRANT THAT THIS WEBSITE, ITS SERVERS, OR EMAIL SENT FROM ROSTERREUNION.COM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
    
4. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE WEBSITE AND/OR THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. 11) Disputes.

You will resolve any claim, cause of action or dispute (“claim”) you have with us arising out of or relating to these Terms or the Website and/or the Services exclusively in a state or federal court located in Santa Clara County. The laws of the State of California will govern these Terms, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Santa Clara County, California for the purpose of litigating all such claims. Notwithstanding this, you agree that Roster Reunion shall still be allowed to apply for injunctive relief remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

12) Indemnity.

Members agree to indemnify and hold Roster Reunion, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of use of the Website and/or the Services in violation of these Terms.

13) Members Outside the United States.

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to Members outside the United States:

i. You consent to having your personal data transferred to and processed in the United States.

ii. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on Roster Reunion (such as advertising or payments).

14) Other.

These Terms and the Privacy Policy constitute the entire agreement between you and Roster Reunion regarding the use of the Website and/or the Services. The failure of Roster Reunion to exercise or enforce any right or provision of these Terms or Privacy Policy shall not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. If any provision of these Terms and/or Privacy Policy is unlawful, void or unenforceable, that provision is deemed severable from these Terms and/or Privacy Policy and does not affect the validity and enforceability of any remaining provisions. Any amendment to or waiver of these Terms must be made in writing and signed by us. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. You may not transfer any of your rights or obligations under these Terms to anyone else without our written consent.  
 

  * Precautions need to be taken when using the Roster Reunion website. Use RosterReunion.com at your own risk. All members are advised to perform a 
  background check and/or a sex offender screening with the federal sex offender data bank if you are thinking of meeting or before you plan on meeting
  with any member found on RosterReunion.com. Again, Roster Reunion assumes no liability or responsibility if any member has provided false information
  or has set up a fake profile resulting in a false identity on RosterReunion.com.  All Roster Reunion members are held accountable for their own safety.
